KonaSearch (“KonaSearch”), and its parent company BasisTech LLC, are very sensitive to privacy issues. We believe it is important for you to know how we treat the information you may provide or make available to us, and how your data is utilized and protected through your use of our website, www.konasearch.com (“Website”) and our products and services (“Services”). This Privacy Policy describes KonaSearch’s policies and procedures regarding the collection, use, and processing of your data from or through our Website and Services.

In accessing or using the Website or Services, you accept all the terms and conditions of this Privacy Policy. Your Personal Information may be processed in the country where it was collected as well as in other countries (including the United States) where laws regarding processing of Personal Information may be less stringent than the laws in your country.

If you do not agree with the terms and conditions of this Privacy Policy you must immediately cease utilizing and accessing the Website or Services.

Information in General

“Personal Information” is information about you that is personally identifiable to you like your name, address, email address, or phone number, as well as other non-public information that is associated with the foregoing. “Anonymous Information” means information that is not associated with or linked to your Personal Information; Anonymous Information does not permit the identification of individual persons.

How We Gather Information

We collect Personal Information that you submit to us voluntarily through our Website or Services.

We collect the Personal Information you provide when registering at our Website, signing up for a demonstration, or for a 30-day trial of our Services, including first and last name, email address, and phone number.

When signing up for a free trial to one of our Services from the Salesforce.com AppExchange, your Salesforce.com user and organization profile details are recorded in our system, along with the installation date and expiration date of the free trial. This includes some Personal Information, including your email address and other Personal Information you entered in your personal profile in Salesforce.com (Setup > My Personal Information > Personal Information). We use this information to contact you with details regarding updates and other issues surrounding our Services, and to provide you Services and support.

Additionally, when you purchase Services from us, we request certain Personal Information from you on our order form. You must provide contact information (such as name, email, and billing address) and if paying by credit card certain details (such as credit card number, and expiration date). We use this information for billing purposes and to fill your order. If we have trouble processing an order, we will use this information to contact you.

If you request customer support services for Services, we will collect Personal Information to enable us to provide such customer support services to you, including your name, mailing address, phone number, email address, and contact preferences. We will also collect other information about the Services you subscribe to, such as the date of purchase and information related to a support or service issue, some of which might be Personal Information.

If you register on the Website for a KonaSearch webinar or participate in a web-based meeting (e.g., through GoToMeeting®) for demonstration or support purposes, you will need to provide the information required by the third party vendor hosting the webinar or web-based meeting. In these cases, your data will be subject to the third party vendor’s privacy policies.

KonaSearch may occasionally provide you the opportunity to participate in contests or surveys on our Website. If you participate, we may request certain Personal Information from you. Participation in these surveys or contests is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes contact information (such as name and address), and demographic information (such as postal code). We may share aggregated demographic information about our user base with our partners. This information does not identify individual users.

Log Files

As is true of most websites and on-demand application software, when you use our Website or our Service we gather certain Personal Information automatically and store it in log files. This Personal Information includes some of the same information you provided when you subscribed to our Service, such as organization and username details, date/time stamp, and details regarding the behavior and performance of our Service during each session.

We use this information to monitor performance and usage patterns, to analyze trends, to administer the system, to identify problems being experienced by individual users, and as an aid to the rendering of customer support.

Cookies

As you navigate our Website or Services, certain Anonymous Information may also be collected passively, including your Internet protocol address, browser type, and operating system. We also use cookies. A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. Our Website and Service typically use a single session ID cookie to help manage resources and to make it easier for you to navigate while using our Website and Service. We use this Anonymous Information to measure the traffic on our Website and Services and to help us make our Website and Services more useful. We delete this information after a period of time.

How we Use your Data

KonaSearch only uses and processes personal information for the purposes described in this Privacy Policy. In addition to uses described elsewhere in this Privacy Policy, such purposes include:

  • Providing our Services;
  • Auditing, research and analysis in order to maintain, protect and improve our Services;
  • Ensuring the technical functioning of Services and otherwise improving Services;
  • To support and maintain Services;
  • Protecting the rights or property of KonaSearch or our users; and
  • Developing new Services.

Unless specifically stated otherwise, any information you provide or that we otherwise acquire from you or on your behalf is never shared with anyone other than KonaSearch or its affiliates.

Data Security

KonaSearch safeguards the security of the data you provide us or that we receive or retrieve from you with industry-standard physical, electronic, and managerial procedures. Likewise, you should take every precaution to protect your Personal Information when you are on the Internet. Change your passwords often, use a combination of letters, numbers and symbols, and make sure you use a secure browser.

The Website and Services use industry-standard Secure Sockets Layer (SSL) encryption. We strongly recommend an SSL-enabled web browser. Web browsers developed after Internet Explorer 3 and Netscape 3 use SSL version 3. (For the best experience at the Website and when using our Service, we recommend using Firefox, Google Chrome, Internet Explorer (version 8 or greater), Opera, Safari or better browsers.)

The details we collect to track your organization’s account status and the names of people using our Services are stored in KonaSearch’s instance of Salesforce.com, in the same manner that you use Salesforce.com to keep track of your own clients and customers. We do not and will not share this information with anyone except as may be required by law.

Services Security

KonaSearch is a software solution hosted in a secured environment by Amazon Web Services (hosting vendor recommended by Salesforce.com) or other trusted third party vendors. KonaSearch has been certified under the stringent requirements of the Salesforce.com AppExchange certification program. This certification included an annual review of KonaSearch’s policies, procedures and application architecture, as well as penetration testing and other assessments. KonaSearch SSL Web Server Certificate provides comprehensive authentication procedures (domain name and identity verification).

It provides 256 or 128-bit encryption depending on your client’s browser capability and the cipher suite installed on Salesforce.com servers and KonaSearch servers.

Data Handling

As part of its installation procedure KonaSearch pushes content from your salesforce.com instance to its private KonaSearch index hosted in the Amazon EC2. All data that is searchable is pushed to the index. Once the system is running, added, changed or deleted data is pushed to the index immediately following the change. Each time a salesforce.com user executes a search query, your salesforce.com instance sends the query to the index. The index finds the results and returns them to your salesforce.com instance.

All transactions between your salesforce.com instance and the index begin with a fully secured validation check to initiate communications. All transfered data, queries and results are encrypted uniquely for your salesforce.com instance while in transit and in index storage. During the installation procedure, the salesforce.com credentials of a specific user are encrypted and stored as part of your Account profile in salesforce.com.

Access to Your Personal Information

You may write to us at support@konasearch.com to request that whatever information we have stored be changed, removed, or provided to you.

Newsletters and Promotional Email

If you no longer wish to receive our newsletters and promotional communications from KonaSearch, you may opt-out of receiving them by following the instructions included in each newsletter or communication or by emailing us at sales@konasearch.com.

Regarding Children

We do not intentionally gather Personal Information about visitors who are under the age of 16.

Links to Other Sites

The Website may contain links to other sites that are not owned or controlled by KonaSearch. Please be aware that KonaSearch is not responsible for the privacy practices of such other sites. We encourage you to be aware when you leave our site and to read the privacy statements of each and every website that collects personally identifiable information.

Information Obtained From Third Parties

KonaSearch does not sell or trade your personal information. We may at times receive contact lists from other organizations. We may send email or physical mailings such as brochures to these addresses. Typically, these are one-time mailings, and the data is not entered into our database. If you want to remove yourself from the third party’s database, you must contact them directly. These mailings have a brochure code printed on the mailing label. By providing this code, we may be able to tell you from where we received your contact info.

Changes to This Privacy Statement

Please note that this Privacy Policy may change from time to time. We will not reduce your rights under this Privacy Policy without your explicit consent, and we expect most such changes will be minor. Regardless, we will post any Privacy Policy changes on this page and, if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of Privacy Policy changes). Each version of this Privacy Policy will be identified at the top of the page by its effective date, and we will also keep prior versions of this Privacy Policy in an archive for your review.
